Terms of Use

By accessing the MLS® data displayed on this website (the MLS® VOW Data), you (the Registrant) agree to the terms below. This site (“LIMINALS”) is operated by Marco Cheng Personal Real Estate Corporation (“PREC”), a licensed real estate representative and member of Greater Vancouver REALTORS®, through the licensed brokerage Royal Pacific Realty (#100–1200 W 73rd Ave, Vancouver, BC V6P 6G5). MLS® VOW Data is made available to GVR members under the MLS® VOW Agreement.

1. Acknowledgements

By clicking to accept these Terms of Use, the Registrant acknowledges and agrees, in favour of the MLS® VOW Participant, the corresponding brokerage, and the Greater Vancouver REALTORS®, that:

1. The Registrant has received, read, and understood the brochure published by the British Columbia Real Estate Association entitled "Privacy Notice and Consent."
2. The Registrant has entered into a lawful REALTOR®/consumer or REALTOR®/client relationship with the Member.
3. All data obtained from this MLS® VOW is intended for, and may only be used for, the Registrant's personal, non-commercial use.
4. The Registrant has a bona fide interest in the purchase, sale, or lease of real estate of the type offered through this MLS® VOW.
5. The Registrant acknowledges GVR's ownership of, and the validity of GVR's proprietary rights and copyright in, the MLS® VOW Data and listing information.
6. The Registrant expressly authorizes GVR, or its duly authorized representatives, to access this MLS® VOW and the Registrant's information for the purposes of verifying compliance with, and pursuing enforcement of, these Terms of Use and all applicable rules, regulations, bylaws, policies, and laws.

2. Prohibited uses

The Registrant must not, and will not permit or assist others to, directly or indirectly:

• Copy, redistribute, or retransmit any of the MLS® VOW Data or information provided;
• Display, post, disseminate, distribute, publish, broadcast, transfer, sell, or sublicense any of the MLS® VOW Data to another person;
• Engage in Scraping (including "screen scraping" and "database scraping"), data mining, or any other activity intended to collect, store, re-organize, summarize, or manipulate any MLS® VOW Data or any related data;
• Use any portion of the MLS® VOW Data in conjunction with artificial intelligence applications, AI chatbots, auto-generative systems, or similar language processing tools, or to train any artificial intelligence or machine learning algorithm, engine, system, or neural network;
• Reverse engineer, decompile, disassemble, or interfere with the website's security or access controls;
• Use the website or any MLS® VOW Data for spamming or other bulk message transmission;
• Remove any proprietary or other notice from any of the MLS® VOW Data.

3. Account, password, and access

Access to MLS® VOW Data requires registration. Each Registrant is issued a unique username and password that expires thirty (30) days from issue and is not automatically renewed. Registrants must keep their credentials confidential and must notify us immediately of any known or suspected unauthorized access.

4. Data accuracy

The MLS® VOW Data is provided on an "as is" and "as available" basis and is deemed reliable but not guaranteed. Listing information may be inaccurate, incomplete, or out of date. All information should be independently verified before relying on it.

5. No financial obligation

These Terms of Use do not impose any financial obligation on the Registrant and do not create an agency agreement. Any financial obligation or agency relationship must be established separately, in writing, set out apart from these Terms of Use, prominently labelled, and may not be accepted solely by mouse-click. Prior to entering into any agency agreement we will ask whether you are a party to any other agency agreement.

6. Representation & agency disclosure

Under the rules of the BC Financial Services Authority (BCFSA) and the Real Estate Services Act, real estate professionals must disclose the nature of the representation they provide before providing trading services. Registering for or using this website does not by itself create an agency relationship. Before any trading services are provided to you, you will be given the BCFSA Disclosure of Representation in Trading Services form. If you are not represented, you will be given the Disclosure of Risks to Unrepresented Parties. Any “Fit Score” or statistic shown on this site is a transparent, rules-based estimate for convenience only, is not an appraisal, valuation, or professional advice, and does not constitute a representation of value.

7. Listing-display limits & data sources

In accordance with the GVR MLS® VOW Policy, no more than 100 listings are returned for any single search inquiry, all data is refreshed at least every 24 hours (the last-update date is shown in the site footer), and MLS® listings are searched separately from any non-MLS® content (such as court-ordered or exclusive listings), which is never co-mingled with MLS® VOW Data. Sellers who have opted out of internet display are excluded from this website.

8. Termination

GVR or LIMINALS may suspend or terminate a Registrant's access at any time, without notice, for breach of these Terms of Use or of the rules of GVR. Upon termination, the Registrant must immediately cease all use of, and securely delete, all MLS® VOW Data in their possession.

9. Privacy

Personal information collected through this site is handled in accordance with our Privacy Policy and British Columbia's Personal Information Protection Act (PIPA) [SBC 2003]. You acknowledge that your personal information may be shared with GVR for auditing and/or legal purposes, and that records of your registration are retained for at least 180 days after your access expires.

10. Governing law

These Terms of Use are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of British Columbia.
